Handling debts and taxes is a crucial stage in probate, ensuring all obligations are met before assets can be distributed to beneficiaries. As the executor or administrator of the estate, we must meticulously review all outstanding debts, including credit card bills, loans, and medical expenses.

Valid creditor claims are paid from the estate funds. It’s important to note that creditors have a limited time frame to file claims against the estate, typically four months from the date of first publication of notice to creditors. We diligently advertise the probate proceedings in local newspapers and directly notify known creditors.

In addition to debts, we are responsible for filing and paying any applicable federal and state taxes. This includes estate taxes, if the estate’s value exceeds the exemption threshold, and final income tax returns for the deceased individual.
