Elder Protection: A Conversation with Ted Cook

Today we’re joined by Ted Cook, an experienced elder protection attorney based in beautiful Point Loma. Ted, thanks so much for taking the time to chat with me.

What inspired you to focus your practice on protecting seniors?

“Well, it started during my early years as a lawyer. I witnessed firsthand how vulnerable older adults can be to exploitation and abuse. It’s heartbreaking to see someone who has worked hard their entire life suddenly facing financial ruin or mistreatment by those they trust. I knew I wanted to use my legal skills to make a real difference in the lives of seniors.”

Could you walk us through the typical steps involved in an elder protection case?

Ted smiles warmly. “It’s not always cookie-cutter, but there are general stages we typically follow to ensure the best outcome for our clients.”

  • Initial Client Engagement: This is where it all begins. We sit down with the senior and their loved ones (if appropriate) to understand their concerns and gather essential background information.
  • Case Assessment: Next, we delve into the specific legal issues at hand. Is this financial abuse? Neglect? Physical harm?
  • Protective Actions: If immediate action is needed, we’ll file restraining orders, contact Adult Protective Services, or even seek guardianship if necessary.
  • Legal Proceedings: This may involve civil lawsuits against abusers, criminal referrals to law enforcement, or navigating probate and guardianship courts.
  • Long-Term Planning: Our goal isn’t just to address the immediate crisis but also to empower seniors with tools for long-term protection. This includes estate planning, advance directives, and ongoing oversight of guardianships.

Let’s dive deeper into “Protective Actions.” What happens during this stage?

“This stage is crucial because it focuses on mitigating immediate risks to the senior’s well-being. For instance, if someone is being financially exploited, we might freeze bank accounts or work with financial institutions to stop unauthorized transactions. Sometimes, a senior may be in danger of physical harm within their own home. We can then help them relocate to a safer environment, whether that’s a family member’s house or an assisted living facility.”

>“We had a case where a client was being manipulated by her caretaker who was siphoning off her funds. Ted was able to step in quickly and stop the bleeding before it got worse. He also helped us find a reliable new caregiver for my mother, which gave us peace of mind.”
Ted recalls a situation where he had to act swiftly: “I remember this one case – a client’s daughter had noticed suspicious activity on her mother’s credit card statements. Turns out, a neighbor was taking advantage of the senior’s trust and racking up unauthorized charges! We were able to report the fraud to the credit card company and law enforcement. It was a huge relief for the family.”

>“Ted Cook is a true advocate for seniors. He helped my father navigate a complex legal situation involving his will and protect him from undue influence by a distant relative. I highly recommend Point Loma Estate Planning APC. “

If someone reading this article suspects elder abuse, how can they get help?

“Don’t hesitate to reach out. You can contact our firm directly, or if you feel someone is in immediate danger, call the police or Adult Protective Services.”

And Ted, any final thoughts for our readers?

>“Protecting our elders is a collective responsibility. Stay vigilant, have open communication with your loved ones, and remember that there are resources available to help. You don’t have to go through this alone.”
