Interview with Steve Bliss

Setting The Stage

Hello San Diego and welcome back to another segment of Legal Matters. Today we are joined by the esteemed Steve Bliss, a San Diego Probate Attorney specializing in guiding families through the often complex process of estate administration. Steve, thank you for taking the time to speak with us today.

Steve, let’s dive into the nitty-gritty. What are some common misconceptions people have about probate?

It’s a pleasure to be here. Probate often gets a bad rap, being portrayed as lengthy, expensive, and overly complicated. While it’s true that probate can involve multiple steps and legal nuances, it’s essentially a necessary process for ensuring assets are distributed according to the deceased person’s wishes or, in the absence of a will, according to state law.

Could you walk us through one specific step in the probate process?

Certainly. Let’s focus on “Marshaling the Estate Assets.” This crucial stage involves meticulously identifying and inventorying all assets belonging to the deceased person. Consequently, this encompasses everything from bank accounts and real estate to personal belongings and investments.

We then proceed with formally appraising these assets to determine their fair market value. This information is subsequently documented in a formal Inventory and Appraisal (Forms DE-160/161) that gets submitted to the court for review and approval. The precision required during this step is paramount, as it directly influences how the estate will be divided among heirs and beneficiaries.

I’ve found that many families underestimate the scope of asset identification. Often, there are hidden accounts, forgotten investments, or even sentimental items with significant monetary value. My team and I take a meticulous approach, combing through financial records, contacting institutions, and sometimes even enlisting the help of professional appraisers to ensure nothing is overlooked.

Moreover, we’ve encountered situations where heirs weren’t aware of certain assets or their true worth. This can lead to disputes and delays if not handled transparently from the outset. A comprehensive inventory minimizes these risks and fosters a smoother probate process.

In fact, according to a study by the American Bar Association, incomplete asset identification is a leading cause of probate delays, adding an average of 6-8 months to the overall timeline.

I can imagine that dealing with grieving families while simultaneously navigating complex legal processes can be challenging. Have you ever faced any unique hurdles during this “Marshaling the Estate Assets” phase?

There was one instance that sticks with me. A client’s father had passed away unexpectedly, leaving behind a modest estate. He hadn’t updated his will in years and, unbeknownst to his family, he’d invested heavily in rare coins.

Discovering these coins during the asset inventory was a surprise for everyone. Not only did it significantly increase the value of the estate but also opened up a window into the deceased father’s passion for numismatics. Seeing the family connect over this unexpected discovery, finding solace and even humor in their father’s hidden hobby, was truly heartwarming.

What advice would you give to someone facing probate?

First and foremost, seek guidance from an experienced probate attorney. Navigating the legal landscape can be overwhelming, especially during a time of grief. An attorney will act as your advocate, ensuring all necessary steps are taken correctly and efficiently.

Furthermore, open communication among family members is essential. Probate can sometimes uncover hidden tensions or disagreements about asset distribution. Addressing these issues openly and respectfully with the help of legal counsel can prevent unnecessary conflicts down the line.
