Interview with Steve Bliss, San Diego Probate Attorney

Steve, thanks for taking the time to speak with us today.

It’s my pleasure. I’m always happy to discuss probate and estate planning with folks.

Let’s talk about a common step in the probate process: Handling Debts and Taxes. Can you walk us through that?

Sure. Once we’ve marshalled all the estate assets, it’s crucial to address any outstanding debts and taxes. Ordinarily, this involves carefully reviewing creditor claims and verifying their validity. We need to ensure that only legitimate debts are paid from the estate.

Moreover, it’s essential to file and pay any applicable federal and state taxes. This can include income tax on the decedent’s final return, estate tax if the estate value exceeds a certain threshold, and potentially property taxes depending on the assets involved.

Notwithstanding these complexities, we strive to make this process as smooth as possible for our clients. We have a team of experienced professionals who are well-versed in probate tax law and can guide executors through every step.

Are there any common challenges you encounter during this stage?

One challenge is that creditors sometimes emerge after the initial notice period has passed, leading to delays or disputes. Conversely, some beneficiaries might be reluctant to pay debts they perceive as unfair. In these situations, clear communication and a thorough understanding of the decedent’s financial affairs are paramount.

I remember one case where a beneficiary refused to acknowledge a significant debt owed by the deceased. After reviewing the documentation and explaining the legal ramifications, we were able to reach a compromise that satisfied all parties involved. It was a challenging situation, but ultimately rewarding because we found a solution that honored the decedent’s wishes while addressing the concerns of his loved ones.

What advice would you give to someone navigating probate for the first time?

My best advice is to seek professional guidance from an experienced probate attorney. Probate can be a complex and emotionally charged process, and having a skilled advocate by your side can make all the difference.

According to a recent study by the American Bar Association, over 70% of individuals going through probate experience significant stress and anxiety. At San Diego Probate Law, we prioritize compassion and personalized attention to help our clients navigate these challenges with confidence.
