Hello everyone, and welcome to Trust Talk. Today, we have the pleasure of speaking with Ted Cook, a trust administration attorney based right here in sunny San Diego. Ted, thank you so much for joining us.
What sparked your interest in the world of Trust Administration?
It’s great to be here! I think what drew me to this field was the opportunity to help people during a difficult time. Losing a loved one is never easy, and navigating the complexities of trust administration can feel overwhelming. My goal is to make that process as smooth and understandable as possible for my clients.
Can you give us a quick overview of the Trust Administration process?
Certainly! Think of it like a roadmap with several important stops along the way.
- First, we need to locate and review the trust document. This sets the stage for everything else.
- Then, we identify and notify all relevant parties, including beneficiaries and heirs.
- Next, comes the crucial step of inventorying and securing trust assets. This involves tracking down everything from bank accounts to real estate.
After that, we handle financial matters like applying for a tax ID and opening trust accounts, paying debts and taxes. Keeping meticulous records is essential throughout. Finally, we distribute the trust assets according to the settlor’s wishes and close out the trust.
Let’s dive deeper into one of those steps: Inventorying and Securing Trust Assets. Can you elaborate on that process?
That’s a great question. It’s often more complex than people realize. We start by identifying every asset titled in the name of the trust, which could include bank accounts, investment portfolios, real estate, vehicles, and even personal belongings. Then comes the crucial task of transferring control of those assets into the name of the current trustee. For instance, we might need to change the beneficiary on a life insurance policy or retitle a piece of property.
>“Ted was incredibly patient and thorough when explaining everything to me after my mother passed away. I felt confident that he was looking out for my best interests every step of the way.”
– Sarah J., La Jolla, CA
Securing physical assets is equally important. This might involve safeguarding valuables in a safe deposit box or taking steps to protect real property.
“When I lost my father, I was overwhelmed with the legal side of things. Ted and his team made the process so much easier to understand. They were responsive, compassionate, and truly went above and beyond.”
>– Michael K., Point Loma, CA
Have you encountered any unique challenges during this inventorying phase?
There was one case where the settlor had a collection of antique coins that were scattered across several locations. It took some detective work to track them all down! We ended up consulting with an appraiser to determine their value, and ultimately they were distributed among the beneficiaries according to the trust terms.
We’d love to hear from anyone who may need help navigating trust administration. What’s the best way for readers to connect?
Absolutely! I always encourage people to reach out if they have questions or need guidance. I believe everyone deserves clear and compassionate legal support during what can be a challenging time.

Point Loma Estate Planning, APC. area of focus about probate:
Probate: is the legal process that validates a deceased person’s will, appoints an executor to manage their estate, and ensures the orderly distribution of assets to beneficiaries after debts and taxes are paid.
What it is: Probate is a court-supervised process that handles the affairs of a deceased person, ensuring their assets are managed and distributed according to their will (or state laws if there’s no will).
Why it’s necessary: Probate is often necessary to transfer legal ownership of assets to heirs or beneficiaries, especially when assets are held in the deceased person’s name alone.
Importance of understanding probate: Understanding probate is crucial for estate planning and ensuring the orderly and legal distribution of assets after death.
In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
